Trainee temporarily under type B authorisation

Pending the integration of trainees into the scheme provided for by EU Directive 2016/801, paid trainees remain eligible for a type B employment authorisation.

This authorisation must be requested by people who are on a work placement, i.e. learning a profession from an employer as part of a training course certified by a diploma or a certificate of studies.

 

This authorisation may be granted if:

  • the trainee is at least eighteen years old and has not reached the age of thirty on the date the temporary employment and employment authorisations are granted (except for trainees recruited by a university, a higher education institution, or a recognised scientific institution);
  • the trainee undertakes not to hold any job in Belgium during the work placement period.

Work placement:

  • must be full time
  • must be paid
  • cannot last more than twelve months
  • may be extended only if the trainee's total period of employment does not exceed twelve months.
  • must be the subject of a work placement agreement translated into the interested party's native language, or into another language that he or she understands. This contract must mention the number of hours of training and the amount of the remuneration, which may not be less than the legally applicable minimum (including the amount of any grants).
  • must be accompanied by a training programme.

How long does it take to process my application?

If your file is complete, the application may take between 1 and 2 months but this can double if your file is incomplete.

 

How can I submit a renewal application?

You can submit an application to renew the type B authorisation if the cumulative work period in Belgium is less than 90 days.

For example, the worker who has already had a one-month contract; if you wish to renew their contract for an additional month, you are still within the 90 days.

If you exceed the 90 days, you must then apply for a single permit.

You must make the application to renew a type B permit at most two months and at least one month before the end of the current type B employment authorisation.

(2) If the employee is abroad, this medical certificate will be issued by a doctor approved by the Belgian diplomatic or consular officials abroad. The medical certificate must have been issued no earlier than three months before the application date. The medical certificate must, if necessary, be translated by a sworn translator into one of the languages of the Region qualified to issue the employment authorisation.
