Seconded workers on a temporary intra-corporate transfer (ICT)

In application of European Directive 2014/66/EU, the system offers easy access to allow workers seconded from a non-European Union Member State to work exclusively or primarily in an entity of the same group located in Wallonia, for a minimum period of 90 days and a maximum of three years (one year for a trainee). The job must also meet the following conditions:

  1. the host entity and the company established in a third company belong to the same company or group of companies;
  2. immediately prior to the transfer date, the seconded worker is employed by this company or group of companies for at least three consecutive months as a professional or managerial staff member, specialist or trainee;
  3. the seconded worker has higher professional qualifications linked to a higher education diploma for professional or managerial staff members and experts or linked to a university diploma for trainees;
  4. the salary of the seconded worker is not lower during the period of the intra-group transfer than that of comparable positions in the host company and in accordance with Belgian legislation.

Single permit

The fixed-term single permit is a work permit AND a residence permit.

The single permit is issued to workers who come to work for more than 90 days.

Where is the application submitted?

For the single permit, the application must be entered online and the supporting documents submitted on the Working in Belgium federal portal.

How long does it take to process my file?

The application must legally be processed within 4 months by the administrations.

The timeframe is generally less for files that are complete and comply with the regulations.

 

How can I submit a renewal application?

The application to renew a fixed-term single permit must be made at most 4 months and at least 1 month before the end of the current permit.

Do other documents need to be supplied?

The permit is issued for a maximum period of 36 months (12 months for a trainee).

When the permit duration exceeds 12 months, the employer sends a copy of the worker's individual accounts for the previous year to the Directorate of Employment and Work Permits on every anniversary date of the authorisation being issued.
